1.5 Waste means any rubbish, items, materials or goods that you ask us to remove, transport or dispose of as part of the Services, subject to the restrictions set out in these Terms and Conditions and in applicable waste regulations.
2. Scope of Services
2.1 We provide rubbish removal and waste collection services, including household waste, office waste, garden waste, and general bulky items, subject to the limitations and exclusions detailed in these Terms and Conditions.
2.2 We operate primarily in Tooting and surrounding areas, but we may agree to provide services in other locations at our discretion.
2.3 Our services generally include loading your waste onto our vehicle, transporting it to an authorised facility, and arranging for lawful disposal or recycling in accordance with applicable regulations.
2.4 We do not undertake building work, dismantling of structures, or specialist cleaning as part of the Services, unless expressly agreed in writing.
2.5 We reserve the right to refuse to collect any waste that we reasonably believe is hazardous, unlawful to transport or dispose of, or outside the scope of what was agreed at the time of booking.
3. Booking Process
3.1 You may request a booking by telephone, email, online form or other method we make available. All bookings are subject to our acceptance.
3.2 When making a booking, you must provide accurate and complete information, including:
a. The collection address and any access details or restrictions.
b. A description of the waste to be collected, including type, approximate volume and weight.
c. Any items that may be heavy, awkward, fragile or require special handling.
d. Preferred date and time window for collection.
3.3 Any quotation provided before we see the waste is an estimate only and is based on the information supplied by you. We reserve the right to revise the price if the actual waste, access or circumstances differ from those described at the time of booking.
3.4 Your booking is only confirmed when we have provided confirmation, which may be by email, text or verbal confirmation, and you have accepted any applicable charges.
3.5 You must ensure that you or an authorised representative is present at the collection address at the agreed time to grant access, confirm the waste to be removed and approve any changes to pricing.
4. Access and Customer Responsibilities
4.1 You are responsible for ensuring suitable access to the property and the waste that is to be removed. This includes arranging any parking permissions, permits or entry codes where required.
4.2 Waste to be collected should be safely accessible and not present a risk to our staff, the public or property. We may refuse to collect items located in unsafe areas or conditions.
4.3 You must separate any items that are not to be removed and clearly identify the waste you want us to collect. We are not responsible for removing items that are not clearly designated as waste, and we accept no liability for items taken in good faith that were not properly segregated by you.
4.4 If we are unable to carry out all or part of the Services due to lack of access, incorrect information, unsafe conditions, or your failure to comply with these Terms and Conditions, we may charge a wasted journey or cancellation fee as set out in the applicable price schedule.
5. Pricing and Quotations
5.1 Prices for our Services are generally based on the volume and type of waste collected, the labour involved, access conditions, and disposal or recycling costs.
5.2 Any quotation given prior to arrival is an estimate only and may change if the quantity, type or location of the waste is different from what was originally described.
5.3 Before commencing work, our team will assess the waste and confirm the final price with you. If you do not agree to the price, you may cancel the Service at that point without charge, provided no work has commenced and no time or materials have been incurred.
5.4 Additional charges may apply for:
a. Excessive weight or volume beyond the initial estimate.
b. Difficult access, such as multiple flights of stairs without lift, long carry distances or restricted entry.
c. Special handling or materials requiring separate disposal streams.
d. Waiting time beyond a reasonable period where our team is unable to start work due to matters under your control.
6. Payments
6.1 Unless otherwise agreed, payment is due in full on completion of the Service and before our team leaves the site.
6.2 We may accept payment by cash, debit card, credit card, bank transfer or other methods we make available. We reserve the right to decline certain payment methods at our discretion.
6.3 For business customers, we may, at our discretion, agree written account terms. Where account terms are agreed, payment shall be made within the timeframe specified on our invoice. Late payments may incur interest and recovery costs in accordance with applicable UK law.
6.4 You are responsible for all charges resulting from the Services provided, including any additional fees or charges agreed on site.
6.5 If payment is not made when due, we reserve the right to suspend further services and to pursue debt recovery, including legal action where necessary. You will be liable for any reasonable costs incurred in recovering overdue amounts.
7. Cancellations, Rescheduling and Wasted Journeys
7.1 If you need to cancel or reschedule your booking, you must notify us as early as possible.
7.2 We may apply a cancellation or rescheduling charge where:
a. You cancel or change the booking with less than 24 hours notice before the agreed arrival time.
b. Our team is unable to gain access to the property or waste at the agreed time for reasons beyond our control.
c. You are not present or contactable at the address during the agreed time window and we cannot proceed.
7.3 Any such charges will reflect the costs incurred by us, including travel time, staff costs and lost opportunity to undertake other work.
7.4 We reserve the right to cancel or reschedule the Service due to unforeseen circumstances, including but not limited to vehicle breakdown, staff illness, severe weather or safety concerns. In such cases, we will endeavour to notify you as soon as reasonably practicable and rearrange the Service at a mutually convenient time. We shall not be liable for any loss arising from such cancellation or rescheduling, save for refunding any sums you have paid in advance for Services not provided.
8. Waste Regulations and Prohibited Items
8.1 We operate in accordance with applicable UK waste management legislation and regulations. All waste collected will be taken to authorised facilities for lawful treatment, recycling or disposal.
8.2 We cannot accept or transport certain types of waste, including but not limited to:
a. Hazardous or special waste, such as chemicals, asbestos, solvents, paints, oils or gas cylinders, unless specifically agreed and compliant with relevant regulations.
b. Clinical or medical waste, including sharps and biological materials.
c. Explosive, highly flammable or otherwise dangerous items.
d. Any materials prohibited by law or by the terms of our licences or permits.
8.3 You are responsible for informing us in advance of any waste that may be hazardous or require special handling. If we discover such waste on site and have not agreed to collect it, we may refuse to remove it and may charge additional fees for any time or costs incurred.
8.4 By providing waste to us for collection, you warrant that you have the right to dispose of it and that it does not contain items that are stolen, unlawfully obtained or otherwise not lawfully in your possession.
9. Title to Waste and Documentation
9.1 Title to the waste passes to us once it is loaded onto our vehicle, subject to compliance with these Terms and Conditions and applicable laws.
9.2 We may issue appropriate documentation as required under waste regulations, such as waste transfer notes for certain types of collection. You must retain any documentation provided in accordance with your own legal obligations.
9.3 We reserve the right to decline to provide Services or to return waste if we reasonably suspect that it may breach applicable regulations or that the information provided about the waste is materially inaccurate or misleading.
10. Liability and Limitations
10.1 We will exercise reasonable skill and care in providing the Services. However, our liability to you is limited as set out in this clause.
10.2 We are not liable for any pre-existing damage to your property, fixtures, fittings or items, nor for wear and tear or damage that could not reasonably be avoided in the normal performance of the Services.
10.3 You must notify us of any alleged damage caused by us as soon as reasonably practicable and, in any event, within 48 hours of completion of the Service. We may request reasonable evidence, such as photographs or reports, and an opportunity to inspect the alleged damage.
10.4 To the fullest extent permitted by law, we shall not be liable for:
a. Any loss of profit, loss of revenue, loss of business, loss of data, or loss of opportunity.
b. Any indirect, consequential or special loss or damage.
10.5 Our total aggregate liability to you arising out of or in connection with any Service, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall be limited to the total fees paid or payable by you for that specific Service.
10.6 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
11. Customer Indemnity
11.1 You agree to indemnify us and keep us indemnified against all claims, losses, damages, costs and expenses arising out of or in connection with:
a. Your breach of these Terms and Conditions.
b. Any inaccuracy or omission in the information you provide about the waste or the property.
c. Any claim by a third party that you did not have the right to dispose of the waste collected.
12. Insurance
12.1 We maintain insurance cover as required under applicable laws for our operations. This may include public liability and employer liability cover.
12.2 Our insurance does not replace your own household, commercial or contents insurance. You should ensure that you have appropriate cover in place for your own property and belongings.
13. Events Beyond Our Control
13.1 We shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include, but are not limited to, extreme weather, road closures, traffic incidents, accidents, strikes, civil unrest, acts of government or failure of utilities.
13.2 Where such an event occurs, we will notify you where reasonably practicable and will use reasonable efforts to resume the Services as soon as it is safe and reasonably possible to do so.
14. Complaints
14.1 If you are dissatisfied with any aspect of our Service, you should contact us as soon as possible so that we can investigate and, where appropriate, seek to resolve the issue.
14.2 We may ask you to provide reasonable details of your complaint, including dates, addresses, photos and the names of any staff involved.
15. Data Protection and Privacy

17. Governing Law and Jurisdiction
17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
17.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter or formation.
18. General Provisions
18.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be struck out to the minimum extent necessary and the remaining provisions will continue in full force and effect.
18.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
18.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another business where reasonably necessary for operational reasons, provided this does not materially affect your rights.
18.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the provision of the Services and supersede any previous agreements, understandings or arrangements, whether oral or written.
